- Providing accurate and current information.
- Keeping contact and billing details up to date.
- Protecting account credentials.
- Using secure passwords.
- Preventing unauthorised access to the account.
Customers should notify AHMINIX LTD as soon as possible if unauthorised access is suspected.
Reasonable identity verification may be required before security-sensitive account changes are completed.
3. Orders
Submitting an order does not necessarily mean that the order has been accepted.
Orders may be subject to payment confirmation, service availability, fraud and security checks, verification requirements, technical feasibility and compliance with these Terms & Conditions.
An order is considered accepted when AHMINIX LTD confirms the order or begins providing the relevant service.
An order may be rejected or cancelled where reasonably necessary, including in cases of suspected fraud, incorrect pricing, legal restrictions, abusive activity or technical inability to provide the requested service.
Where an order is cancelled before the relevant service has been provided, amounts paid for that cancelled service will normally be refunded where applicable.
4. Prices and Payments
Prices are displayed or quoted before purchase and may vary depending on service type, configuration, billing period, promotional offers and additional features.
Customers are responsible for paying all applicable charges associated with their orders.
Billing and payment information must remain accurate and current.
Payments may be processed through third-party payment providers that may apply separate terms and privacy policies.
Applicable taxes and legally required charges may be added where necessary.
5. Renewals
Some services may operate on a recurring billing basis.
Where automatic renewal is enabled and disclosed, the service may renew automatically at the end of the billing period unless cancelled.
Renewal prices may differ from introductory or promotional pricing.
Customers are responsible for keeping payment details and contact information current.
6. Cancellations and Refunds
Cancellation and refund eligibility may depend on the type of service, whether the service has already been activated, whether work has already started, whether the service is customised, whether third-party costs have been incurred, applicable service-specific terms and applicable consumer protection law.
Certain services or third-party costs may not be refundable after activation, registration, licensing or purchase where permitted by law. This may include certain domain registrations, software licences, custom development work, customised digital services and external provider fees.
Nothing in these Terms & Conditions limits any statutory consumer right that cannot lawfully be excluded.
7. Domain Names and Third-Party Services
Domains, SSL certificates, software licences, APIs and other third-party services may be provided through external companies.
Third-party products may be subject to separate rules and policies imposed by the relevant registry, registrar, provider, software vendor or licensor.
AHMINIX LTD cannot guarantee that a requested domain or third-party product will remain available until the registration or provisioning process has been successfully completed.
Customers are responsible for supplying accurate information required for registration and complying with applicable third-party requirements.
8. Hosting Services
Customers using hosting or infrastructure services are responsible for the content, applications, software and activity associated with their accounts unless otherwise agreed in writing.
Hosting services may be subject to technical resource limits according to the purchased plan.
Customers must not use resources in a way that materially affects the stability, security or performance of systems used by other customers.
Where excessive or abusive usage affects service quality or infrastructure stability, reasonable technical measures may be taken.
9. Acceptable Use
AHMINIX LTD services must not be used for illegal, fraudulent, malicious or abusive activities.
Prohibited activities include:
- Malware distribution.
- Phishing.
- Credential theft.
- Unauthorised access to systems or accounts.
- Botnets.
- Malicious command-and-control infrastructure.
- Distribution of viruses or malicious code.
- Fraud.
- Identity impersonation.
- Unauthorised bulk messaging or spam.
- Illegal copyright infringement.
- Hosting unlawful material.
- Network attacks.
- Denial-of-service attacks.
- Attempts to bypass security controls.
- Use of stolen or compromised accounts.
- Use of stolen or unauthorised payment methods.
- Activities that materially threaten the security or reliability of infrastructure.
Suspected violations may be investigated and appropriate action may be taken.
10. Customer Content
Customers retain ownership of content they own and upload to the services.
AHMINIX LTD is authorised to technically process, host, transmit, copy and back up customer content only as reasonably necessary to provide and protect the contracted services.
Customers are responsible for ensuring that they have the legal right to use, store and distribute their content.
Content must not violate applicable law or the rights of third parties.
11. Intellectual Property
Unless otherwise stated, AHMINIX LTD retains all applicable rights relating to the website, branding, logos, software, source code, interfaces, documentation, graphics, original content, systems and technology.
For custom development services, ownership and licensing rights may be defined separately in the relevant quotation, proposal, contract or project agreement.
No intellectual property rights are transferred unless expressly agreed.
12. Development and Custom Services
Custom development, design, integration and technical work are provided according to the agreed scope.
The project scope may be defined through a quotation, proposal, order or written agreement.
Requests outside the original scope may require additional charges or changes to the expected completion date.
Customers are responsible for providing required content, credentials, approvals, feedback, technical information and other project dependencies.
Delays caused by missing customer information, third-party systems or circumstances outside reasonable control may affect completion dates.
13. Backups
Where backups are included with a service, they are intended as an additional risk-reduction measure.
Backups do not replace the customer's own backup responsibilities unless otherwise agreed in writing.
Backup frequency, retention and availability may vary depending on the service.
Customers should maintain independent copies of important data whenever reasonably possible.
AHMINIX LTD does not guarantee that every file, database or historical version will always be recoverable from backups.
14. Security
Reasonable technical and organisational security measures are used to protect services and infrastructure.
Customers remain responsible for security matters under their own control, including password security, software installed by the customer, application updates, plugins and extensions, access permissions, compromised personal devices and custom code not managed by AHMINIX LTD.
Urgent action may be taken where necessary to protect systems, customers or infrastructure from an active or suspected security threat.
15. Service Availability and Maintenance
Technology services may occasionally become unavailable due to scheduled maintenance, emergency maintenance, hardware failures, software failures, network issues, security incidents, third-party service failures, internet routing issues or events outside reasonable control.
AHMINIX LTD aims to provide reliable services but cannot guarantee uninterrupted or error-free operation unless a specific written service level commitment applies.
16. Suspension of Services
A service may be temporarily restricted or suspended where reasonably necessary due to overdue payments, a serious violation of these Terms & Conditions, security risks, suspected fraud, illegal activity, abuse reports requiring investigation, legal requirements or serious threats to infrastructure or other customers.
Where appropriate and reasonably possible, customers may be notified and given an opportunity to resolve the issue.
Immediate action may be taken where required to prevent harm, fraud, illegal activity or significant security risk.
17. Termination
Customers may cancel services according to the applicable cancellation process.
AHMINIX LTD may terminate services where a material breach remains unresolved, payment obligations remain outstanding, services are repeatedly used in violation of these Terms & Conditions, continued service would be unlawful or continued service creates a serious security or operational risk.
Termination does not automatically remove charges or obligations that arose before termination.
Customers are responsible for exporting or backing up required data before termination where access remains available.
Customer data may be deleted following termination in accordance with applicable retention and deletion procedures.
18. Payment Disputes and Chargebacks
Customers who believe that a payment is incorrect should contact AHMINIX LTD so that the matter can be reviewed.
Submitting a chargeback or payment dispute does not automatically remove a legitimate payment obligation.
Where a payment dispute creates a reasonable fraud or security concern, affected services may be temporarily restricted while the matter is reviewed.
Nothing in this section restricts statutory rights relating to unauthorised or incorrect payments.
19. Third-Party Dependencies
Certain services may depend on external providers such as data centres, network providers, cloud providers, domain registries, payment processors, software vendors and external APIs.
AHMINIX LTD is not responsible for events entirely outside reasonable control but will take reasonable steps within its control to address issues affecting services.
20. Liability
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation would be unlawful.
To the maximum extent permitted by law, AHMINIX LTD is not responsible for indirect or consequential losses that were not reasonably foreseeable when the relevant contract was formed.
Business customers may be subject to additional liability provisions contained in separate written agreements.
Nothing in this section affects mandatory consumer rights.
21. Customer Responsibility
Customers are responsible for ensuring that purchased services are suitable for their requirements.
Customers are also responsible for the legality and accuracy of information, content and software they provide or operate through the services.
Unless specifically agreed otherwise, customers remain responsible for technical matters under their own control.
22. Events Outside Reasonable Control
AHMINIX LTD is not responsible for failures or delays caused by circumstances outside reasonable control.
Such circumstances may include major network failures, natural disasters, widespread infrastructure outages, government actions, armed conflict, major third-party cyber incidents and external service provider failures.
This does not affect rights that cannot legally be excluded.
23. Changes to Services
Reasonable changes may be made to services where necessary for security, legal compliance, regulatory compliance, technical improvements, infrastructure changes, compatibility, abuse prevention or service development.
Where a significant change materially affects an ongoing paid service, reasonable steps may be taken to provide notice where appropriate.
24. Changes to These Terms
These Terms & Conditions may be updated from time to time.
The latest version will be published on the website with the applicable revision date.
Additional notice may be provided for material changes where appropriate.
25. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
26. No Waiver
Failure to immediately enforce a provision of these Terms & Conditions does not waive the right to enforce that provision later.
27. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of England and Wales, subject to mandatory rights available under applicable consumer law.
For business customers, the courts of England and Wales will have jurisdiction unless otherwise agreed in writing.
Consumers may have additional legal rights concerning the jurisdiction in which legal proceedings may be brought.
28. Contact Information
Questions relating to these Terms & Conditions or the services may be submitted through the official contact or customer support channels available on the website.
